Retro Gaming Studios Warranty Policy
This warranty policy outlines the terms and conditions for warranties on products sold by Retro Gaming Studios. It applies to both new and second-hand retro video game products purchased through our website. This policy is governed by Australian Consumer Law.
Definitions:
- Manufacturer's/Standard Warranty: Any expressed or implied warranty offered by the original manufacturer of a new product for a specific period from the original date of purchase. This applies primarily to new items we sell.
- Retro Gaming Studios Warranty: Our own warranty offered on both new and second-hand products, covering mechanical or electrical failure under specific conditions.
- Mechanical or Electrical Failure: A sudden and unforeseen failure of a product arising from a mechanical or electrical fault, not caused by misuse, neglect, or external factors.
- Original Date of Purchase: The date shown on the purchase receipt and/or tax invoice issued by Retro Gaming Studios.
- Original Purchase Price: The amount shown on the purchase receipt and/or tax invoice, representing the cost of the product from Retro Gaming Studios.
- You/Your: The person or persons named as the purchaser on the original purchase receipt and/or tax invoice from Retro Gaming Studios.
- Product: Any video game console, game cartridge/disc, accessory, or other item purchased from Retro Gaming Studios.
- We/Us/Our/Retro Gaming Studios: Refers to Retro Gaming Studios (ABN [Insert ABN if applicable]), the selling retailer.
What Our Warranty Covers:
For new products, we honour the original manufacturer's warranty. Please retain your proof of purchase for any warranty claims.
For both new and second-hand products, Retro Gaming Studios provides a warranty against mechanical or electrical failure for a period of 1 year from the original date of purchase. This warranty covers defects that Retro Gaming Studios determines are not due to user fault.
Specifically, our warranty covers:
- Faulty components or workmanship present at the time of sale.
- Mechanical or electrical failure occurring during normal use within the warranty period.
Our warranty does not cover:
- Damage caused by misuse, neglect, accidents, liquid spills, power surges, improper handling, or unauthorized modifications.
- Normal wear and tear, cosmetic damage, or minor imperfections that do not affect the product's functionality.
- Damage caused during shipping if improper packaging is used by the customer for returns.
- Data loss or corruption on storage media (e.g., game saves).
- Compatibility issues with third-party accessories or software.
- Products purchased from unauthorized resellers.
Second-Hand Products:
As many of our products are pre-owned, minor cosmetic imperfections may be present. We strive to accurately describe the condition of each item in its product listing, including photos. Returns based on cosmetic imperfections described in the listing will be considered a change of mind and are not covered under warranty.
Returning a Product:
- Contact Us: You must contact our customer service team via [Phone number/Email address/Contact form on website] before returning any product to obtain a Return Authorization (RA) number.
- Packaging: All returned products must be securely packaged to prevent damage during transit. Include all original accessories and packaging (if available). We are not responsible for damage incurred during return shipping due to inadequate packaging.
- Shipping: You are responsible for the cost of return shipping. We recommend using a trackable shipping method and insuring the package.1
- Assessment: Upon receiving the returned product, we will assess it to determine the cause of the fault.
What We Will Do:
If the product is covered under warranty, we will, at our discretion:
- Repair the product.
- Replace the product with the same or a comparable item (if available).
- Issue a refund for the original purchase price.
If the product is not covered under warranty (e.g., due to user damage), we will contact you with a repair quote (if possible). You will be responsible for any repair costs and return shipping fees.
Transfer of Warranty:
Our warranty is non-transferable and applies only to the original purchaser.
Limitation of Liability:
Our liability under this warranty is limited to the original purchase price of the product. We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or data loss.
Australian Consumer Law:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement2 or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.3
